Terms of service
Last updated: 30/10/2026
These terms govern the use of EtherGreen (the "Platform") by the companies and consultancies that subscribe to it and their users (the "Customer"). By creating an account you accept them. The Platform is meant for businesses and professionals, not consumers. The Spanish version is the reference text.
1. Provider
- Zoa López Pastó
- NIF: 53399459Z
- Email: [email protected]
2. The service
EtherGreen is a software-as-a-service (SaaS) platform for:
- uploading bills, receipts and other documents and reading the activity data from them;
- calculating the carbon footprint (Scopes 1, 2 and 3) with official emission factors;
- generating reports and statements (for example GHG Protocol, VSME, ESRS E1, TCFD, EU Taxonomy, SECR, PPN 06/21 and RD 214/2025);
- answering customer questionnaires and, for consultancies, managing several companies or groups.
3. Account
The Customer must give accurate information, keep their credentials confidential and be authorised to act for the company they register. They are responsible for activity on their account. New companies may be reviewed before they are activated.
4. Price and payment
Plans, prices and payment terms are those shown in the offer or on the Platform when subscribing. Unless stated otherwise, subscriptions renew automatically for the same period and can be cancelled before renewal. Amounts already paid are not refunded unless the law says otherwise.
5. Acceptable use
The Customer agrees not to:
- copy, modify, decompile or try to obtain the source code;
- use the Platform for unlawful purposes;
- upload other people's data without a legal basis;
- access servers, accounts or data without authorisation, or interfere with the service.
We may suspend access in case of misuse or security risk.
6. Customer data
The Customer's documents, data and reports belong to the Customer. They grant us a limited licence to process them only to provide the service. We do not sell them, share them or use them to train AI models.
7. Data processing
Where Customer data includes other people's personal data, the Customer is the controller and EtherGreen acts as processor (Art. 28 GDPR). In that case EtherGreen will:
- process the data only on the Customer's instructions, which are to provide the service;
- make sure the people authorised to process it are bound by confidentiality;
- apply the security measures described in the Privacy policy;
- use only the sub-processors listed in the Privacy policy (Hetzner and Mistral AI) and tell the Customer before adding others, so they can object;
- help the Customer respond to data subject requests and meet their security and breach notification duties;
- delete or return the data when the service ends, unless the law requires it to be kept;
- provide the information needed to show compliance.
8. Artificial intelligence and calculations
AI is used to read documents, answer questions and draft text. Emissions are calculated by code with official published factors (DESNZ, MITECO, REE, CNMC and others), citing the source, year and method of each calculation. Missing data is flagged, never estimated.
The Customer must review and confirm extracted data and generated text before using it. The Platform's reports are not an audit or independent verification and do not replace professional advice.
9. Availability
We work to keep the service available at all times but cannot guarantee it will be free of interruptions or errors. We may suspend it temporarily for maintenance, updates or security reasons, with notice where possible.
10. Intellectual property
The Platform, its code, design, algorithms, databases and brand belong to the owner. The Customer may not copy, resell or create derivative works from them without express permission. White-label consultancies may show their own brand on their clients' reports.
11. Term and termination
The Customer can cancel at any time. We may suspend or cancel access for breach of these terms, non-payment, security risk or unlawful use.
After cancellation the Customer can ask for a copy of their data for 30 days; after that it is deleted, unless the law requires it to be kept.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect damage, loss of profit, data loss caused by the Customer, or decisions the Customer takes based on the reports. Our total liability to the Customer is limited to the amounts paid in the 12 months before the event that gave rise to it. Nothing here limits liability for wilful misconduct or gross negligence.
13. Changes to the terms
We may change these terms. We will give reasonable notice of important changes; continuing to use the service afterwards means accepting them.
14. Governing law and jurisdiction
These terms are governed by Spanish law. The parties submit to the courts of Madrid (Spain).
